1. Acceptance of Terms

By accessing or using GrowthMap ("the Service"), operated by JMS Dev Labs, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. We may update these terms from time to time, and continued use of the Service constitutes acceptance of any changes.

2. Description of Service

GrowthMap is a marketing companion application that helps small business owners execute their marketing plans through guided daily tasks, AI-powered content suggestions, and gamified progress tracking. The Service is available as a web application at mygrowthmap.net and as an embedded Shopify app.

3. Accounts

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account.

You may create an account using email/password authentication through our web application, or by installing the app through the Shopify App Store, which creates an account linked to your Shopify store.

4. Subscription & Billing

GrowthMap offers three subscription plans:

Starter — $9.99/month: 1 marketing plan, AI content generation, daily quests & streaks, progress & mastery tracking, and email support.
Professional — $19.99/month: Up to 50 marketing plans, AI content generation, daily quests & streaks, progress & mastery tracking, weekly email digest, and priority support.
Enterprise — $29.99/month: Unlimited marketing plans, AI content generation, daily quests & streaks, progress & mastery tracking, weekly email digest, and dedicated support.

All plans include a 14-day free trial. No credit card is required to start your trial. After the trial period, you must subscribe to continue using the Service.

Payments are processed securely through Stripe (for web subscribers) or Shopify Billing (for Shopify App Store installations). We do not store your payment card details directly.

5. Cancellation & Refunds

You may cancel your subscription at any time from your Settings page. Upon cancellation, you will retain access to the Service until the end of your current billing period. We do not offer prorated refunds for partial billing periods.

If you cancel during your free trial, no charges will be applied. For Shopify installations, uninstalling the app will automatically cancel your subscription.

6. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose or in violation of any applicable laws
Attempt to gain unauthorized access to the Service or its related systems
Interfere with or disrupt the integrity or performance of the Service
Use the Service to generate spam, misleading content, or content that violates third-party rights
Reverse engineer, decompile, or disassemble any part of the Service
Share your account credentials or allow others to access your account

7. AI-Generated Content

GrowthMap uses artificial intelligence to generate marketing content suggestions, including social media posts, email copy, SEO descriptions, and other marketing materials. This content is provided as a starting point and should be reviewed and edited before use.

You are solely responsible for any content you publish based on AI suggestions. We do not guarantee the accuracy, appropriateness, or effectiveness of AI-generated content. AI suggestions are generated using your business context and do not constitute professional marketing advice.

8. Intellectual Property

The Service, including its design, features, and underlying technology, is owned by JMS Dev Labs and protected by intellectual property laws. You retain ownership of any content you create or upload to the Service, including your marketing plans and business data.

By using the Service, you grant us a limited license to process your content as necessary to provide the Service, including generating AI suggestions based on your business context.

9. Limitation of Liability

To the maximum extent permitted by law, JMS Dev Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify you of material changes by posting the updated terms on our website with a revised "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the modified terms.
